It comes in a document called "Gaceta Judicial" (Colombia), which explains the dispute, the court ruling, the high court appeal, the charges, etc. In what looks like a title, there is "Se considera", after which comes the following (extract from various paragraphs)

Por ser ésa la doctrina sobre la cual descansa sin duda alguna el article 2341 del C.C., se tiene por verdad sabida que quien por sí o a través de sus agentes causa a otro un daño, originado en hecho o culpa suya, está obligado a resarcirlo, lo que equivale a decir que quien reclame a su vez indemnización por igual concepto, tendrá que demostrar, en principio, el perjuicio padecido, ....
I just can't think of a way to put "Se considera" as a title, in UK English. "The following is considered"?

First of all, the paragraph refers to the Civil Code (CC) when it cites "Se considera" in this case Article 2341 and proceeds to relate that whomever harms another ... is obligated to repair the damage or make amends. Now, by the same token, whoever is claiming damages has to prove his case.
It is not a new case ruling or a court finding whatsoever. I am a Colombian native and I know how a case is presented. Again, if one reads carefully it will come to light easily. The entire paragraph rests on the Art. from the CC that states "the case" that is apparently being brought on.
