Prior mediation will apply in cases detailed as follows: 1. Misdemeanors; 2. Criminal negligence; 3. Offenses against property committed by individuals **sin mediar*** violence or intimidation, and 4. Offenses punishable with less severe punishment

Not sure if you really need "the use of" here; I think just "without violence" will do. "Mediar" just means "involving", but that sounds a little odd to my ears in this construction.

"Artículo 56.- Mediación. La mediación procederá en:
1. Las faltas;

3. Los delitos patrimoniales cometidos entre particulares sin mediar violencia o

agree Taña Dalglish : https://tureng.com/en/spanish-english/delito patrimonial (esp. with regard to the reading of numeral 3). What I am unsure of though is numeral 2 (asker has "criminal negligence"); this may need a different question (imprudentes y culposos)? Stay safe.

Thanks, Taña, yes, "delitos patrimoniales" could be "crimes against property" to be more precise. I'd have to have a closer look at "imprudentes y culposos".
