This is an option for companies in financial difficulties, facing bankruptcy, under Brazilian Law 11,101 of 2005. A company can apply to court on its own initiative for approval to perform debt restructuring, or can ask for this option as a defense against bankruptcy proceedings. If the court gives the green light, the company must win the approval of the majority of its creditors for its proposed restructuring plan (longer payment periods, debt reduction, everything is allowed as long as the creditors approve the plan).
The government is not involved and makes no financial contribution. The law simply provides a legal framework for executing a recovery plan, IF AND ONLY IF it is approved by creditors. Otherwise, the judge will declare the company bankrupt.

Não sei se o conceito existe nos EUA, mas não é um auxílio governamental para uma empresa em dificuldades. No caso da recuperação judicial, a empresa ajuiza um pedido de recuperação judicial e apresenta um plano de recuperação, que, uma vez aprovado pelo juiz, é submetido à aprovação dos credores reunidos em assembleia. Se os credores aprovam o plano, a empresa entra então em recuperação judicial e deve seguir o plano apresentado.

Há uma diferença fundamental: no bail-out o governo resgata a empresa. Na recuperação judicial são os credores que a resgatam. O conceito, embora similar, não é o mesmo. Acho que teríamos que usar algo na linha de "Chapter 11", então.

Um bail-out não passa necessariamente necessariamente pela Justiça e pode ser dado pelas autoridades do poder executivo para salvar por exemplo bancos e instituições financeiras.
Acho que a diferença principal entre os 2 casos é que na recuperação judicial existe a intervenção efetiva da Justiça.
