That said, in the USA the term for "recuperação judicial" would be Chapter 11." or bail-out, depending on the context.

As has been said by others a bail-out is the use of public funds to rescue a private company. In business rescue/recovery proceedings the rescue can be effected, e.g. by an injection of funds by the shareholders, by the forgiveness or scheduling of debts, by the conversion of debt into share capital, etc., etc.

Chapter 11 (para os USA) - Chapter 11 is a chapter of the United States' Bankruptcy Code, which permits reorganization under the bankruptcy laws of the United States. Chapter 11 bankruptcy is available to every business, whether organized as a corporation or sole proprietorship, and to individuals, although it is most prominently used by corporate entities. In contrast, Chapter 7 governs the process of a liquidation bankruptcy (although liquidation can go under this chapter), while Chapter 13 provides a reorganization process for the majority of private individuals.

It depends on the audience (Brazil or the USA) The technical term used in the USA is either Bail-out or Chapter 11 (whereby the government does exactly what is described below).

Um bail-out não passa necessariamente necessariamente pela Justiça e pode ser dado pelas autoridades do poder executivo para salvar por exemplo bancos e instituições financeiras.

Acho que a diferença principal entre os 2 casos é que na recuperação judicial existe a intervenção efetiva da Justiça.

legally-backed debt/financial restructuring

This is an option for companies in financial difficulties, facing bankruptcy, under Brazilian Law 11,101 of 2005. A company can apply to court on its own initiative for approval to perform debt restructuring, or can ask for this option as a defense against bankruptcy proceedings. If the court gives the green light, the company must win the approval of the majority of its creditors for its proposed restructuring plan (longer payment periods, debt reduction, everything is allowed as long as the creditors approve the plan).

The government is not involved and makes no financial contribution. The law simply provides a legal framework for executing a recovery plan, IF AND ONLY IF it is approved by creditors. Otherwise, the judge will declare the company bankrupt.

It may be appropriate to include the word "corporate" in the translation. The Brazilian law has some similarities to Chapter 11 reorganization in the US, but is not applicable to individuals, only to certain kinds of businesses and companies.

Já que o fenômeno não existe em paises de idioma inglês, não há um termo correto e usar o termo que não corresponde não é solução. Portanto, a tradução precisa explicar o fenômeno.

Não sei se o conceito existe nos EUA, mas não é um auxílio governamental para uma empresa em dificuldades. No caso da recuperação judicial, a empresa ajuiza um pedido de recuperação judicial e apresenta um plano de recuperação, que, uma vez aprovado pelo juiz, é submetido à aprovação dos credores reunidos em assembleia. Se os credores aprovam o plano, a empresa entra então em recuperação judicial e deve seguir o plano apresentado.

o Governo realmente nao injeta dinheiro na empresa, mas da condiçoes de pagamente mais beneficas a empresa, comopor exemplo ate 2 anos de carencia, reparcelamento da divida etc... sera que se eu usar o bail-out em um abstract fica errado?

Há uma diferença fundamental: no bail-out o governo resgata a empresa. Na recuperação judicial são os credores que a resgatam. O conceito, embora similar, não é o mesmo. Acho que teríamos que usar algo na linha de "Chapter 11", então.

O que é recuperação judicial?
A recuperação judicial é uma medida legal destinada a evitar a falência, proporcionando ao empresário devedor a possibilidade de apresentar, em juízo, aos seus credores, formas para quitação do débito.

A reaffirmation agreement is a written contract entered voluntarily between a Chapter 7 debtor and a creditor. Here the debtor promises to pay all or a portion of the money that s/he owes to the creditor, regardless of the bankruptcy filing. By a reaffirmation agreement the debtor agrees to make payments throughout the course of the bankruptcy proceedings until complete satisfaction and accomplishment of all money or obligations owed. The purpose of filing a reaffirmation agreement is to allow a creditor keep with him/her the collateral or mortgaged property which would otherwise be subject to repossession. A reaffirmation agreement helps a debtor to waive the discharge of debt which would otherwise be discharged in the pending bankruptcy proceeding.
