The QFI shall "entrust its" PRC Custodian(s) to the PBC and SAFE as described in the Regulations on Funds of Domestic Securities and Futures Investment by Foreign Institutional Investors (PBC & SAFE Circular [2020] No. 2) .

Mir ist nicht klar, wie "entrust" hier zu verstehen. Im Prospekt wird "Custodian(s)" mit "Depotbank(en)" übersetzt. Oder geht es hier um die Verwahrungsfunktionen?

Registrierung Ich habe übrigens folgende Aussage gefunden (BNY Mellon): "After the investment license is granted, the local custodian will register the QFI with the State. Administration of Foreign Exchange (SAFE)." Demzufolge könnte die Bedeutung meines o.g. Satzes auch folgende sein: "Der QFI beauftragt die VRC-Depotbank(en), seine Registrierung bei der PBC und der SAFE zu veranlassen." Was haltet ihr davon?

Möglich Das ist natürlich möglich, aber in diesem Prospekt wurde die der Begriff "Depotbanken" (als ÜS von Custodian) in den Definitionen festgelegt. Und es wird auch ansonsten an keiner Stelle auf Verwahrstellen verwiesen.

Custodian Im "Zahn" sind Depotbank und Verwahrstelle ohne Anmerkungen oder Priorisierung unter Custodian aufgeführt. Was spricht dagegen, diese Begriffe als Synonyme zu behandeln? Siehe auch Steffens Beitrag.

Danke ... schon mal an euch beide! Ich hatte auch das Gefühl, dass hier Satzteile fehlten bzw. die Formulierung nicht ganz zutreffend war.

Auf etwas verpflichten? Ich würde hier vermuten, dass der qualifizierte ausländische Investor dafür Sorge zu tragen hat, dass die von ihm beauftragte(n) Verwahrstelle(n) in China die entsprechenden Vorschriften einhalten ("to make PBC and SAFE regulations binding upon its PRC custodian(s)" oder "to ensure compliance of its PRC custodian(s) with PBC and SAFE regulations"). Es könnte aber auch um eine für die Verwahrstellen bestehende Melde-/Registrierungspflicht bei PBC und SAFE gehen. Die Verwendung des Verbs "to entrust" scheint mir hier nicht ganz treffend zu sein.

D.h. ich könnte es evtl. so verstehen, dass der Qualified Foreign Investor die Verwahrstelle "as described in the Regulations on Funds of Domestic Securities and Futures Investment by Foreign Institutional Investors (PBC & SAFE Circular [2020] No. 2)" (= gemäß ...) mit der Registrierung von X bei der Nationalbank & der Staatlichen Devisenamt beauftragen wird (Futur = Verpflichtung, das gibt es seit ein paar Jahren auch im dt. Rechtsjargon, unsere AGB wurden vom Anwalt bereits so verfasst.)
