Soy madre cabeza de familia de los menores de edad CAMILO ERNESTO INSUASTY OBANDO, de 16 años de edad, y LAURA VELASQUEZ OBANDO, de 6 años de edad, quienes siempre han dependido totalmente de mí y han estado bajo mi cuidado; he sido una mujer responsable y trabajadora y me he esforzado por brindarle a mis hijos todo lo que han necesitado, pero en razón a mi detención mis hijos se encuentran a cargo de mi madre de avanzada edad.
Soy Licenciada en Lenguas Modernas de la Universidad de Nariño y Socióloga de la Universidad Nacional, en el momento de mi detención estaba cursando la maestría en “Estudios Políticos y Relaciones Internacionales” en la Universidad Nacional de Colombia. Así mismo, me desempeñaba como defensora de derechos humanos en La Federación Nacional Sindical Unitaria Agropecuaria (FENSUAGRO).
Estoy siendo judicializada arbitrariamente por los delitos de rebelión y administración de recursos, en razón al trabajo que desarrollaba en defensa de los derechos de los trabajadores del agro, por ello me considero Prisionera Política de Conciencia victima de un montaje judicial.
Fui detenida por órdenes de la Fiscalía General de la Nación el 8 de agosto de 2008, y actualmente ostento la condición de SINDICADA dentro del proceso penal adelantado por el Juez Noveno Penal del Circuito Especializado de Bogotá, OSCAR GUSTAVO JAIMES VILLAMIZAR.
Durante mi detención se me ha negado la casa por cárcel, derecho constitucional al que tengo como madre cabeza de familia.
HECHOS
1. Desde el mes de abril del año 2009 a la fecha, he denunciado el abuso de autoridad que han cometido guardianas en el patio 6 de la Reclusión de Mujeres el Buen Pastor, contra las prisioneras políticas que allí habitamos, tales como requisas degradantes en horas nocturnas, comportamiento hostil, maltrato verbal y psicológico, amenazas verbales de traslado, irrespeto a la dignidad humana, obstrucción de visitas de abogados, engaños con fines de sometimiento a interrogatorios ilegales, decomiso arbitrario de artículos autorizados, entre otros. (Ver denuncias anexas con fecha abril 18 de 2009, septiembre 2 de 2009, septiembre 9 de 2009, diciembre 2 de 2009 y diciembre 30 de 2009).
2. Además de las denuncias escritas, en diferentes oportunidades he denunciado de manera verbal los atropellos de la guardia, especialmente los cometidos a partir del mes de septiembre del año pasado, con la finalidad que se cese el maltrato dado a las prisioneras, especialmente el maltrato al que me han sometido, puesto que he tenido que soportar injurias y señalamientos por parte de la guardia, para lo cual han utilizado información de reserva de mi proceso, ejemplo de ello es el falso y constante señalamiento publico que la dragoneante DIANA SALINAS ha hecho tildándome de ser la amante del abatido miembro de las FARC alias Raúl Reyes, hecho totalmente falso que además viola el debido proceso y la presunción de inocencia.
3. Por mis constantes reclamos se me ha excluido de participar en actividades de derechos humanos que se han realizado en la reclusión y se ha obstaculizado la visita de mis abogados y defensores de derechos humanos que hacen seguimiento a mi condición de reclusión, a quienes les han informado falsamente que yo me opongo a recibir sus visitas.
4. El 30 de diciembre de 2009, las prisioneras políticas fuimos objeto de una requisa arbitraria protagonizada por las funcionarias LEIDY PAOLA ROMERO, ZOILA PEÑALOSA, DAYANA CRISTINA AGUILAR y la teniente MARÍA DEL CARMEN MARTINEZ LEIVA, quien ese día ejercía de comandante de vigilancia; en desarrollo de dicha requisa fui maltratada físicamente y me fue decomisado un discman que estaba autorizado por las autoridades competentes del establecimiento; ante mis reclamos la guardia optó por presentar una falsa denuncia contra mi, alegando que yo había agredido a las funcionarias y que portaba un mp3, elemento no autorizado en la reclusión. Prueba de la falsa denuncia es que existen testigos que observaron la agresión de la guardia y que funcionarios de policía judicial me devolvieron el discman en el mes de febrero porque si contaba con la debida autorización.
5. Recientemente tuve conocimiento que la teniente MARÍA DEL CARMEN MARTÍNEZ LEIVA ha solicitado mi traslado a otro sitio de reclusión, aprovechando la falsa denuncia que han presentado las guardianas agresoras; esto constituye una represalia en mi contra que amenaza la cercanía familiar y por ende mis derechos fundamentales y los de mis hijos menores de edad, así como mi condición de sindicada.
CONTEXTO
Estos hechos denunciados, especialmente los ocurridos en el mes de diciembre, han desatado la animadversión de las guardias mencionadas hacia mí, quienes mantienen una actitud de venganza por las quejas formales escritas y verbales que he presentado ante sus jefes inmediatos por sus excesos, abusos y trasgresión de su propio reglamento en lo referido a la “relación y trato con las internas” y extralimitación en el ejercicio de sus funciones.
Todas las quejas y denuncias que he presentado las he fundamentado en las disposiciones de la Constitución Nacional, los Códigos Penal y de Procedimiento Penal, el Código Penitenciario y Carcelario (ley 65 de 1993), el Decreto 407 de 1994, las Reglas Mínimas para el Tratamiento de los Reclusos y otras Reglas Internacionales en lo que respecta al trato digno y respetuoso de nuestros derechos humanos como personas privadas de la libertad.
Durante todo el tiempo que he estado privada de la libertad he mantenido una conducta ejemplar, aportando a la convivencia pacifica en el patio 6 donde me encuentro, donde ninguna de mis compañeras de reclusión tiene ni ha presentado queja alguna por mi comportamiento.
Igualmente, en ocho (8) ocasiones he solicitado prisión domiciliaria en mi condición de madre cabeza de hogar, mis hijos menores de edad dependen de mí, sin embargo, las peticiones han sido negadas, y no bastando esta situación, se propone un traslado que desestabilizaría a todo mi núcleo familiar, me alejaría de mis hijos y de mi madre de avanzada edad, y obviamente se constituiría un castigo adicional al que ya padezco con el solo encierro y las limitaciones de mis derechos.
Recuerdo que la responsabilidad primaria de protección de los derechos humanos recae de acuerdo con los principios constitucionales y el articulado de los tratados y Convenios Internacionales sobre el Estado colombiano, al ser éste el sujeto responsable de velar por el cumplimiento de lo consagrado en la Constitución Nacional y por ser el que adquiere los compromisos en materia de derechos humanos y de derecho internacional humanitario ante la comunidad internacional. Por tal razón, su mayor deber jurídico es el de prevenir las violaciones frente a estos derechos y tomar las medidas necesarias para investigar, identificar, juzgar y sancionar a los responsables por su acción u omisión, o tomar las medidas correctivas de carácter administrativo o político que impida que estos crímenes se sigan perpetrando.
PETICIONES
1. Que el Ministerio de Justicia, la Dirección General del INPEC y la Dirección de la Reclusión de Mujeres de Bogota, intervengan urgentemente para que cese el comportamiento de persecución y agresión que he padecido y se me ofrezcan todas las garantías de respeto a mis derechos fundamentales, en consecuencia, NO SE ME TRASLADE DE ESTABLECIMIENTO DE RECLUSIÓN, toda vez que mi núcleo familiar se encuentra en la ciudad de Bogotá y la corte constitucional ha determinado que las y los reclusos deben estar en establecimientos donde se encuentre su núcleo familiar y su proceso, puesto que aún me encuentro en calidad de sindicada y mi proceso lo adelantada un Juez de Bogotá.
2. Que la Procuraduría General de la Nación y la Defensoría del Pueblo ejerzan una vigilancia especial a las denuncias que he presentado y a las investigaciones que se han adelantado contra las funcionarias del INPEC DIANA SALINAS, ESPERANZA GAONA, MÓNICA VALVUENA, LEIDY PAOLA ROMERO, ZOILA PEÑALOSA, DAYANA CRISTINA AGUILAR Y MARIA DEL CARMEN MARTÍNEZ LEIVA, para que se tomen las medidas a que hubiere lugar por su conducta.
3. Que se ejerza una vigilancia permanente para que se garantice que producto de esta denuncia, no se cometerán retaliaciones en mi contra.
4. Que los organismos nacionales e internacionales defensores de derechos humanos, escriban sus cartas de apoyo a esta acción urgente a las siguientes direcciones:
Translation - English BACKGROUND
I am a mother and head of household with two young children CAMILO ERNESTO INSUASTY OBANDO, of 16 years of age, and LAURA VELASQUEZ OBANDO, of 6 years of age, who have always been completely dependent on me and have always been under my care; I have always been a responsible, hardworking woman and have always striven to provide for all of my children’s needs, but due to my detention my children have been left in the care of my elderly mother.
I have a degree in Modern Languages from the University of Nariño and a Sociology degree from the National University of Colombia, at the time of my detention I was studying for a masters in ‘Politics and International Relations’ at the National University of Colombia. I also acted as a Human rights defender for the Federation of the United National Agricultural and Aquacultural Union (FENSUAGRO).
I am being tried arbitrarily for the crimes of rebellion and resource administration for organising appeals, due to the work I did in defence of the rights of the agricultural industry, for which I am considered a Political Prisoner of Conscience victim of a legal set-up.
I was detained by order of the Attorney General’s office on August 8 2008, and am currently held ACCUSED by the penal system as decided by the 9th Penal Judge of the Specialized Circuit of Bogotá, OSCAR GUSTAVO JAIMES VILLAMIZAR.
Throughout my detention I have been denied my home, a constitutional right I have as mother and head of household.
FACTS
1. From April 2009 to the present day, I have denounced the way in which the wardens of yard 6 of the Good Shepherd Women’s Prison have abused their authority, against the political prisoners that are held there, such as degrading searches during the night, hostile behaviour, verbal and psychological abuse, threats of transfer, lack of respect for human dignity, blocking lawyers’ visits, tricking prisoners into submitting to illegal interrogation, arbitrary and confiscation of authorized property, amongst other things. (Refer to the complaints recorded under the dates April 18 2009, September 2 2009, September 9 de 2009, December 2 2009 and December 30 2009).
2. As well as the written complaints, in many instances I have verbally denounced the guards’ violation, especially those committed from last September onwards, with the aim of putting an end to this mistreatment of prisoners, especially the treatment to which I have been subjected, given that I have had to deal with the slander and accusations made against me by the guards, for which they have used information reserved for my trial, one example being the constant false public accusations that guard DIANA SALINAS has made, branding me as the lover of the assassinated FARC (The Revolutionary Armed Forces of Colombia) member, Raúl Reyes, a complete falsehood that furthermore damages the trial process and the presumption of innocence.
3. As a result of my constant demands they have excluded me from participating in human rights activities that have been carried out at the prison and they have made it difficult for me to see my lawyers and human rights defenders who are monitoring the conditions of my imprisonment, and whom they have falsely informed that I do not want to receive such visitors.
4. On December 30 2009, political prisoners were the object of an arbitrary search carried out by workers LEIDY PAOLA ROMERO, ZOILA PEÑALOSA, DAYANA CRISTINA AGUILAR and the deputy MARÍA DEL CARMEN MARTINEZ LEIVA, who on that day was in charge of the guard duty; through this search I was physically abused and they confiscated a Discman which the authorities of the establishment had authorized me to; faced with my complaints the guard chose to present false report against me, alleging that I had attached the workers and that I had an MP3, an unauthorized object in prison. Proof of the false report lies in the witnesses that observed the guards’ aggression and that the Judicial Police returned the Discman to me in February as I had the necessary authorization.
5. I recently discovered that the deputy MARÍA DEL CARMEN MARTÍNEZ LEIVA had requested my transfer to another prison, using the false testimony presented by the assailing guards; this constitutes a reprisal against me that threatens my proximity to my family and therefore my basic rights s and those of my young children, as well as my position as accused.
CONTEXT
These denouncements, especially those that took place in December, has lead to the guards antagonism towards me, and they maintain an attitude of vengeance due the formal written and verbal complaints that I have presented to their bosses due to their excessive abuses, a transgression of their own regulations with reference to ‘Treatment and relationship with inmates’ and is and oversteps the requirements their role.
I have based all the complaints and denouncements that I have presented on the regulations of the National Constitution, the Penal Code and legal Proceedings, The Penitary and Prison Code (Law 65 made in 1993), Decree 407 made in 1994, the basic regulations for the treatment of the detained and other International regulations with regards to dignified treatment and respect for our human rights as prisoners.
Throughout all the time that I have been detained I have behaved impeccably, contributing to pacific cohabitation in yard 6, where I am held, none of my fellow inmates have made a single complaint against my behaviour.
Furthermore, on eight (8) occasions I have requested residential imprisonment due to my status as a mother and head of household, my young children depend on me, however, my requests have been rejected, and as f this wasn’t enough, they are proposing a transfer which would completely destroy all family unity, they want to send me away from my children and elderly mother, which would obviously constitute additional punishment to that which I am already undergoing through imprisonment and my limited rights.
I recall that the initial responsibility of human rights protection lies in accordance with constitutional rights and with the International treaties and agreements with the Colombian state, which is responsible for ensuring the National Constitution is adhered to and fulfil its commitments in terms of Human rights and Human rights laws before the International community. For this reason, their greatest legal responsibility lies in preventing violations of these rights and to take the necessary steps to investigate, identify, judge and penalize those responsible for violations or neglect, or to take the necessary disciplinary actions of an administrative or political nature in order to prevent these crimes from happening.
DEMANDS
1. That the Ministry of Justice, the management teams of INPEC and of the Women’s prison of Bogotá, urgently intervene to put an end to this persecution and aggression that I have had to suffer and that they guarantee the respect of my basic rights, and accordingly, THEY DO NOT TRANSFER ME TO ANOTHER PRISON, given that my family live in Bogotá and the Constituent assembly has determined that those detained should be held close to where their families live and their trail, if I am still held accused, is carried out by a judge from Bogotá.
2. That the Attorney General and the Ombudsman carry out a special investigation of the denunciations that I have presented and of the investigations that are being carried out on employees of INPEC DIANA SALINAS, ESPERANZA GAONA, MÓNICA VALVUENA, LEIDY PAOLA ROMERO, ZOILA PEÑALOSA, DAYANA CRISTINA AGUILAR Y MARIA DEL CARMEN MARTÍNEZ LEIVA, so their actions are dealt with appropriately.
3. That a permanent watch is kept to guarantee that as a result of this denouncement, acts of retaliation will not be carried out against me.
4. That national and international Human Rights organisations, write letters of support for this urgent action to the following addresses:

De dezembro de 2007 a 2 de abril de 2008 o Ministério da Saúde infomra ter recibido 70 notificações de casos suspeitos de febre amarela. Destes, 40 foram confirmados (21 evoluiram para óbito), 26 foram descartados e quatro ainda estão em investigação. O primeiro caso foi confirmado em 16 de dezembro de 2007 e a última notificação feita em 23 de março de 2008. Os casos confirmados, provavelmente, adquiriram a doença em areas rurais de Goiás, do Distrito Federal, de Mato Grosso do Sul, de Mato Grosso, do Paraná e do Pará.
Embora a infecção tenha occurido em área rural ( transmissão silvestre), os casos de febre amarela, em geral, são reconhecidos e diagnosticados em áreas urbanas. Durante o período no qual o vírus está presente no sangue, uma pessoa pode servir de fonte de infecção para o mosquito. No Rio de Janeiro, como em outras cidades, existe o mosquito Aëdes aegypti, que transmite o dengue e também pode transmitir a febre amarela. Portanto, a possibilidade da transmissão urbana existe permanenetemente desde a reintrodução do Aëdes aegypti nas cidades brasileiras, no final da década de setenta….
Translation - English Yellow fever in Brazil
The Ministry of Health reports that between December 2007 and April 2 2008 it had received 70 reports of suspected cases of yellow fever. Of these, 40 were confimed ( 21 proved fatal), 26 dismissed and four were still being investigated. The first case was confirmed on December 16 2007 and the last reported case was on March 23 2008. It is likely that those with confirmed cases of yellow fever contracted the illness in rural areas of Goiás, the Federal District, Mato Grosso do Sul, Mato Grosso, Paraná and Pará.
Although the infection occured in rural areas ( sylvatic transmission), in general, cases of yellow fever are discovered and diagnosed in urban areas. Whilst the virus is present in the blood, a person acts as a carrier and can infect mosquitoes. The Aëdes aegypti mosquito, the insect that transmits dengue and also yellow fever, can be found in Rio de Janeiro and in other cities. the risk of urban transmission is ever present since the reintroduction of the Aëdes aegypti in Brazilian cities in the late 1970s.....
